A New Mexico security guard is accused of retaliating against a drunken customer at a gas station while also intoxicated, KOB reported.
Frankie Garcia was charged with aggravated battery and assault in the Sunday incident at a convenience store in Albuquerque, the television station reported.
"Two drunks together is not a good thing," Jim Cusic, the branch manager of Signal 88, told KOB. Cusic said Garcia has been fired from the company.
According to a police report, a drunken customer was upset after he was not permitted to enter the convenience store and began punching and kicking Garcia, the television station reported.
Police said Garcia retaliated and tried to repel the customer off with a baton, pepper spray and a BB gun. Witnesses said Garcia "seemed to miss every strike" with his baton. The customer also had BB gun imprints on his stomach, KOB reported.
Cusic told the television station that Garcia was not supposed to have those weapons.
“Frankie was a level 1 security officer,” Cusic said. “He has to use his brain.
“Last night’s incident was the first time this happened, and it was not his normal character.”
