An Austin man may be sorry for writing that he was sorry for burglarizing an acquaintance’s home after police used the signed apology as the chief piece of evidence to have him arrested, according to police.

Mark Dana Kenady, 56, was arrested and charged Monday with burglary of a residence, according to his arrest warrant. His bail has been set at $20,000 and he is also being held on a parole violation, jail records show.

The burglary was reported May 2 at an apartment in southeast Austin, an arrest affidavit said.

The victim of the burglary returned home from work that day and found the front window of his apartment broken. He soon realized that a flat-screen television and about $50 in cash had been taken from the home, the affidavit said.

A handwritten note was left on a kitchen counter, it said.

The note said the victim did not appreciate Kenady and mentioned an interaction between the two the night before the break-in in which the victim refused to lend Kenady $2. Kenady ended the note by telling the victim not to be upset and that Kenady still appreciated the victim, the affidavit said.

Investigators found the signature at the end of the letter to be very similar to Kenady’s signature on his Texas identification card, the document said.
