An Indianapolis man pleaded guilty to molesting his now 7-year-old daughter who is battling cancer, and he won't be serving a prison sentence.
Jeremy Schwer pleaded guilty this week to felony child molesting.
Prosecutors had argued that Schwer should serve nine years behind bars and three years probation, but the girl's mother wrote a letter to the judge, asking him not to put her husband in jail, The Indianapolis Star reported.
The girl's mother said that Schwer needed to be freed because she hopes that her husband will help financially support her and their children.
The mother has filed for divorce from Schwer.
She was also the person who called the state's department of child services when the allegations first came to light.
A judge sentenced Schwer to 12 years probation and required him to register as a sex offender, The Indianapolis Star reported.
Schwer was also ordered to leave the family's home so his family could move back in.
Schwer has been out of jail, living in the family home for the past year, but has not paid support for his family, prosecutors told The Indianapolis Star.
His attorney said that Schwer was fired shortly after his arrest and has just recently started a new job and said he plans on supporting his estranged family.
The little gil was diagnosed with a brain tumor in 2013. She spent months in the hospital and a year of chemotherapy, The Indianapolis Star reported.
