A New York City boutique baker, known for a cake made of 20 crepes, is out almost $90,000 after a delivery truck driver swiped the sweets for "unauthorized resale," The New York Times reported.

Lady M Confections created the Mille Crepes cake that has 20 French paper-thin pancakes stacked and covered in fluffy cream and a layer of caramelized sugar.

But David Lliviganay is now accused of taking the cakes and selling them himself, the Times reported.

He was charged earlier this year with 15 counts of petty larceny, pleaded guilty in July and is scheduled for sentencing Sept. 24, but that's not the end of the case.

A civil lawsuit filed last week by Lady M's owners showed how much cake they said Lliviganay took starting last November

Lliviganay was recorded on surveillance camera taking the cakes 36 times over three months, the lawsuit said, according to the Times.

In all, the company officials said he took 1,020 cakes totaling $89,250. The average cost of each cake is just under $90.

They found out about the heist when "unauthorized resellers" were selling the crepe cake at a discount, the Times reported.

In addition to the surveillance footage, Lliviganay's phone connected to the company's network the same day at the same time of the thefts, the lawsuit said, according to the Times.

Llivinganay no longer worked for the company at the time of his guilty plea, having told his bosses that he was going on vacation on Valentine's Day and never returning. He was officially fired in March, the Times reported.

Lady M's owners are seeking full repayment for the cakes.
