The Texas police officer shown throwing a girl to the ground and pulling a gun on youths at a recent pool party in a shocking viral video was previously sued for alleged racial profiling.
According to San Antonio Express-News, Robert Earl Brown Jr., a black man, accused McKinney police Officer David Eric Casebolt of racial bias and using excessive force in a 2008 lawsuit, which was later dismissed.

In the complaint, Brown said Casebolt pulled down Brown's pants on the side of the road and touched Brown's "private area" in an April 2007 search. Brown claimed that Casebolt said he had spotted marijuana seeds in Brown's car but found nothing. Brown also said Casebolt called him a "dope dealer" and one of Brown's companions a "crackhead." The complaint said other officers slammed Brown's head into a police vehicle and sexually assaulted his companion. Read more about the complaint here.

Attorneys for Casebolt and the other officers said the authorities found marijuana seeds, a bag of marijuana and crack-cocaine while searching Brown and his companions. A motion claimed officers pushed Brown onto the police vehicle because he was trying to reach for a weapon and remove his handcuffs, the Express-News reported.

A judge reportedly dismissed the complaint in 2009.
A lawyer confirmed Tuesday that Casebolt has resigned after the release of a video that appears to show him using profanity, slamming 15-year-old Dajerria Becton to the ground, and drawing his weapon on other teens at a pool party at Craig Ranch North Community Pool. The department is investigating the incident.
