A California local district attorney’s office has decided not to file charges against the motorist who struck and killed a mother of two, who was also a local school district trustee.

On Tuesday, the Alameda County District Attorney’s Office said it was not pursuing criminal charges against the motorist whose SUV fatally struck Catherine Kuo, a mother of two and a Dublin Unified School District trustee.

Kuo died in March after she was struck by a vehicle while volunteering at a food distribution event at a Dublin middle school, according to MSN.

Kuo, 48, was loading items onto a parked Tesla in March when she was struck by an SUV, according to the San Francisco Chronicle. The driver, whose name has not been released, was next in line at the food distribution event, police said.

The driver was found to be “at fault for the accident, but there was no criminal intent found,” Dublin Police Capt. Nate Schmidt told the Chronicle on Tuesday. In March, Schmidt said police “don’t think was an intentional act by any means.”

On Tuesday, William Kuo, Catherine Kuo’s husband, was appointed the new trustee for the region his late wife represented.

In a statement addressed to the school district community in March, officials expressed their grief over Kuo’s death.

“Our heart goes out to Catherine’s family and friends,” the district said. “We can’t begin to fathom the impact of this loss to you. She dedicated so much of her heart, soul, and time to our community. Catherine had a lightness about her, a comforting manner that helped people feel at ease. She was friendly, nurturing, kind, and generous. We were lucky to have known her and will miss her more than words can express.

“There is a gaping hole in our hearts. Our schools, students, staff, and families are forever indebted to her.”
