A 72-year-old Powder Springs man who was struck while riding on his motor scooter in May has died from his injuries, and charges against the driver who hit him have been upgraded, according to Cobb County police.

Paul Hodges of Powder Springs died Saturday, never recovering from the accident near the intersection of Hiram Lithia Springs Road and Hill Road on May 25.

Hodges, traveling on his yellow scooter, was northbound on Hiram Lithia Springs Road when he was struck from behind by a red 2004 Chevrolet Colorado pickup driven by Gary Smith, 65, of Lithia Springs. The impact ejected Hodges from his scooter and into the path of a 1972 Oldsmobile Cutlass traveling westbound on Hill Road.

Smith was initially charged with failure to yield after the accident. The charge has been upgraded to second-degree vehicular homicide.
