The sex offender living legally above an Atlanta children's museum has been arrested again.
William Ausbrooks, 46, was arrested late Monday after a story aired on Channel 2 Action News, a spokeswoman for the Fulton County Sheriff's Office said. The latest arrest was because Ausbrooks failed to contact the sheriff's office following a March arrest on a theft charge, according to Tracy Flanagan with the sheriff's office.
Ausbrooks is living with a relative inside the Museum Tower building on Centennial Olympic Park Drive, directly above Imagine It, a children's museum. Neighbors aren't happy, but it isn't illegal for Ausbrooks, a convicted child molester, to live in the condo.
That's because Ausbrooks committed the crime before Georgia's current sex offender law was put into place.
Under Georgia law, anyone who committed a sex crime after June 4, 2003, is restricted as to where they can live. The law states that they cannot live within 1,000 feet of places like schools and playgrounds or anywhere that’s a gathering place for children.
But the same law states that anyone who committed a sex crime before that date does not have the same restrictions and can legally live almost anywhere.
Following his March arrest, Ausbrooks was released on $7,500 bond. But he failed to report to the sheriff's office within 72 hours of that release, a violation of the sex offender law, Flanagan said.
Ausbrooks will now have to face a hearing before a judge to see if he will serve out the remainder of his sentence.
