A Chamblee man was charged Monday with assault and child cruelty for holding a gun on his wife and 2-year-old son, authorities said.

Police said Humberto Diaz, 31, appeared to be intoxicated Monday when he was arrested at his apartment at 70 Pearl Lane.

Around 12:40 p.m., police responded to a report of shooting from the address.

Diaz's wife, Rosie Chile, told police her husband was jealous and thought she was cheating on him.

She said Diaz put a handgun to her head while she was holding her son and said, "I'm going to kill you," police said.

Then Diaz fired several shots through the window of the apartment, police said.

Two other men in the apartment fled, one taking the handgun with him, authorities said.

Offers later found the .9mm handgun under a pillow in the apartment, and police caught Diaz going out the back door, authorities said.

Diaz was charged with felony aggravated assault, child cruelty, reckless conduct, aiming a gun, and reckless conduct.

He is being held on $9,000 bond in the DeKalb County jail.
