The brother of Paulding County killer Nicholas Cody Tate is asking state and federal judges to allow him to pursue appeals on his condemned brother's behalf.

Tate, convicted of killing Chrissie Williams and her 3-year-old daughter Katelyn in 2001, is set to be executed Jan. 31. Tate has yet to file his habeas corpus appeals -- routine in capital cases. Dustin Tate, serving a life sentence for the same crimes, has filed motions to litigate final appeals on his brother's behalf. An audit from the University System of Georgia found Albany State University admitted several hundred freshmen who failed to meet minimum test score requirements.

The college must improve the services offered to students with disabilities and the way staff stores student files, the report said.

Albany Stare President Everette Freeman scheduled a meeting for Friday to discuss the report with students, faculty and staff.  Freeman said the college is providing additional training to fix the problems and will use new controls to prevent them from happening again.

"Right now, we are working to address all of the issues," Freeman said in a statement.

A Lithonia man was sentenced Wednesday to 22 years and six months in federal prison for armed bank robbery and illegal firearms violations.

Cepeda Broughton, 41, walked into Georgia's Own Credit Union in Conyers on March 9 brandishing a pistol and ordering a customer and four employees to the back of the bank. After binding them with duct tape, Broughton left with more than $140,000 in cash, but he was later arrested after a high-speed chase that caused multiple accidents and a foot race by pursuing officers, the U.S. Attorney's Office said.
