The man accused of causing a crash that killed a California woman as he tried to escape police waived his first court appearance Tuesday morning.

Demarco Mosley has been charged with homicide by vehicle, theft by taking, marijuana possession and reckless driving in connection to the Sunday crash.

Officers were attempting to stop a stolen red Chevrolet Malibu that was driving northbound on Peters Street, Atlanta police Sgt. Warren Pickard said. Mosley, who was driving the Malibu, accelerated to get away from police and ran a red light at the intersection with McDaniel Street, police said.

After running the red light, Mosley struck a the passenger side of a white Ferrari, killing Janae Rice, according to investigators. Both Mosley and the Ferrari’s driver, whose name was not released, were treated for minor injuries.

Rice, 32, was visiting Atlanta to celebrate a friend’s birthday.

Mosley was also charged with having an expired license and an obstructed driver’s view. His next court date is scheduled for June 13.
