Q: Just as the federal government has taken to court many petroleum companies for price gouging, have there been any efforts to do the same with pharmaceutical companies? — John Spotts, Atlanta
A: In 2008, the Federal Trade Commission and the Minnesota Attorney General’s Office sued then-Ovation Pharmaceuticals (now Lundbeck Inc.) for alleged price gouging of a drug that is used to treat premature babies with a life-threatening heart condition. The complaint, filed in U.S. District Court in Minnesota, accused the Illinois-based company of raising the price of Indocin nearly 1,300 percent, from $36 to nearly $500 a vial after its January 2006 acquisition of the drug NeoProfen. The trial is scheduled to start in December.
