A former officer at the Fulton County Jail has been accused of abusing an inmate and trying to cover it up.

Lee M. Hutley of Austell already has been fired over of the allegations. Now, a federal grand jury has indicted him, according to the federal prosecutor in Atlanta.

Hutley, 31, has been indicted on two felony charges of using excessive force against an inmate and on one felony charge of writing a false incident report about it, U.S. Attorney Sally Quillian Yates said in a written statement Wednesday. Hutley was informed of the charges at an initial court appearance Wednesday before U.S. Magistrate Judge Alan J. Baverman.

Hutley allegedly used pepper spray on an inmate in handcuffs, then hit him repeatedly, injuring him, Yates said. He also is accused of writing a false incident report afterward to obstruct any investigation.

The FBI is investigating.
