The man accused of sucking a woman's toe inside an Augusta-area Wal-Mart won't face charges.

That's because the man, Joey William Leaphart, asked the woman if he could suck her toe and she consented, Capt. Steve Morris with the Columbia County Sheriff's Office told the AJC on Wednesday.

An 18-year-old woman, whose name was not released, told police she was shopping earlier this month when Leaphart approached her and asked if her toenails were painted, according to the Columbia County sheriff's report, obtained by The Augusta Chronicle.

Leaphart, of Langley, then allegedly told the woman he worked for the television show "America's Funniest Home Videos," according to police.

"The man told her he was with the show and said that if she complied with his requests, everything she purchased that day would be free," according to the newspaper. "She reluctantly agreed to his taking a picture of her foot."

But when Leaphart allegedly started sucking her toe behind a clothing rack, the woman screamed at him to leave.

"It tasted so good, though," Leaphart allegedly told the woman as he left the store.

Leaphart's criminal history includes arrests for similar toe-sucking acts, according to the newspaper. He pleaded guilty in December 2000 following an arrest for licking the toes of an 11-year-old girl.
