A suspect has been arrested in the fatal shooting of a convenience store clerk, the DeKalb County Sheriff's Office said Friday.

Earlin Lee Turner, 52, was taken into custody Thursday by members of the DeKalb fugitive squad in the 2000 block of Lake Park Drive after being spotted by authorities. He was arrested without incident and taken to the DeKalb County Jail.

Turner, of Smyrna, is charged with felony murder in the death of  Damodar Pathak, who was shot in the abdomen at the BP gas station and convenience store in the 2100 block of Cedar Grove Road before midnight Monday.

A witness told authorities that two men went inside the store, and Turner allegedly shot the clerk as he entered the game room area. The men left on foot before police got to the scene.

Pathak, 39, died at Grady Memorial Hospital, DeKalb police Sgt. H.K. Stafford previously told the AJC.

Surveillance photos of the two men in the store were released by police.

DeKalb police said the second man was cleared of wrongdoing and released after turning himself in earlier this week.
