A 38-year-old man was arrested after allegedly shooting in a northwest Atlanta park where children were playing, according to a police report obtained Tuesday by The Atlanta Journal-Constitution.
Brian Ellis pulled into a park on James Jackson Parkway, where about 100 people had gathered about 8:30 p.m. Saturday, police said.
He allegedly fired at least 10 shots and struck 53-year-old Kenneth Irby in the hip, the AJC previously reported.
He walked away from responding officers and got into a gray car, police wrote in the report.
At first, Ellis didn’t move or follow officer commands to show his hands and exit the car, but the officer pulled him out and handcuffed him, the report states.
Soon afterward, the officer wrote that Ellis “had a strong odor of an alcoholic beverage coming from his breath; he also had slurred speech and displayed signs that he could not remember recent events.”
Several witnesses told police Ellis was the man who’d fired the shots.
While the officer walked Ellis to the patrol car, Ellis could not keep his balance; “his legs would wobble and buckle,” the report states.
Police found a 40-caliber round in the area and tested Ellis’ hands for gunshot residue. His phone was taken as evidence and his car was impounded, police said.
Ellis remains in the Fulton County jail without bond on charges of cruelty to children, aggravated assault, reckless conduct, DUI and possession of a firearm in the commission of a felony.
He is expected in court Oct. 30, jail officials said.
