Two years after a Pelham jailer was fired following allegations that he raped a woman in custody, the city is facing a lawsuit, officials said.

According to the lawsuit filed Thursday, the city was “deliberately indifferent” to the risk of sexual abuse against the victim and other female inmates.

The Atlanta Journal-Constitution does not identify victims of sexual assault.

Dennis Logan is also named in the suit. He is the former jailer who was fired after a Roswell woman accused him of rape in April 2015, when she was in custody.

At the time, the woman was arrested in Roswell on criminal trespass charges.

In an agreement with the cities of Roswell and Pelham, she was sent to a jail in Pelham, according to the lawsuit. In a 2014 Channel 2 Action News report, the woman said she was sent to the Pelham jail when she couldn't make a $5,000 bond.

Logan woke the victim up about 3 a.m. April 1, 2015, and told her he was going to transport her back to Roswell for a first court appearance, according to the lawsuit. As Logan placed leg irons on the victim, the lawsuit alleges he pushed her against the wall and sexually assaulted her while she was handcuffed.

The victim waited until she was back in Roswell to report the crime for fear of her own safety.

DNA evidence later linked Logan to the crime, Channel 2 reported. A second officer was also fired during the investigation, officials confirmed to Channel 2 Action News, but he was never charged. His name was not released.

The lawsuit comes at a time when the city of Pelham is swamped with several lawsuits alleging sexual contact with jailers, the news station reported.

“We are not prepared to answer how we will defend this, but we will put a defense and do the best to get to the bottom of it and do justice for everyone concerned,” the city said in a statement to Channel 2.

The charges against the victim have since been dropped and her lawyers are gathering information about other potential victims.

Logan is expected to go before a grand jury in June.
