A Fulton County grand jury returned a 14-count indictment Tuesday against two men charged in the killing of an Alabama construction worker outside an Atlanta Kroger supermarket earlier this year.
Damarius Thompson, 25, is charged with six counts, including four counts of felony murder, in the death of Joshua Richey, who was finishing a job near the supermarket on Ponce de Leon Avenue when he was killed March 10.
Thompson’s alleged accomplice, Shontavious Chestnut, 25, is charged with felony murder.
Richey, 38, was fatally shot after attempting to stop a thief from breaking into his work vehicle.
When he confronted the thief, Thompson allegedly shot him through the vehicle's window and then escaped in a car driven by Chestnut. The indictment alleges both men were attempting to break into cars in the Kroger parking lot shortly before the killing..
Kroger's Atlanta division offered a $25,000 reward for any information leading to the arrest of the shooter.
Thompeson was arrested March 26 at a Popeyes fast-food restaurant close to the scene of the killing. Chesnut was arrested April 9 at a relative's home in Pensacola, Fla.
Both men have previous arrest records, with Thompson having served in state prison twice. He was most recently released in January 2014 after serving about 17 months after being convicted for terroristic threats and acts. Chestnut was arrested for probation violation in June 2014, and both men have been convicted on theft charges in the past.
The case will be assigned to a Fulton County Superior Court judge and scheduled for trial.
