Apparent Bartow County shootout ends with 1 man dead, 1 in custody

One man is in custody and another is dead after an apparent shootout in a Bartow County house Sunday afternoon, authorities said.

About 1 p.m., deputies responded to Sugar Valley Road after a 911 caller said two men had been shot, according to a sheriff’s office incident report. When deputies arrived, they spotted a woman standing in the house’s front doorway with a man standing behind her.

The deputy told both of them to raise their hands, and while the woman listened, the man closed the door, the report said. The deputy told the woman to get on the ground, which is when the man reopened the door and began to comply with orders.

The deputy noticed that the man, later identified as 73-year-old Gary Thomas Posey, was bleeding from the left side of his stomach, the report said. Posey, who was described as an older man by the deputy, later said that “(Posey) did not realize he had been shot.”

When authorities searched through the house, they found a dead man in a room with a gun and another gun in a nearby bedroom. The man who had been killed, identified as 50-year-old Eric Wayne Martin, had been shot multiple times.

The woman told the deputy that she was asleep when Posey entered her room, grabbed a gun and told her, “I’m going to kill that son of a (expletive),” the report said. She then heard three gunshots.

Neighbors told investigators that they also heard between three and four gunshots, indicating a shootout between Posey and Martin, according to the report.

Posey, whose age was not provided, was taken into custody. He remains in the Bartow County Jail without bond on counts of murder (family violence) and possession of a firearm during the commission of a felony, according to jail records.

This homicide investigation began just hours before another deadly incident was discovered in Bartow County, but the latter still has many unanswered questions.

Five people were found dead in an apartment near Cartersville about 4:30 p.m. Sunday, AJC.com previously reported. The sheriff’s office called in the GBI to assist with the investigation.
