A Gainesville man is accused of tying a dog to train tracks and leaving him there to die.

Gerardo Damian-Rosas was arrested Dec. 1 and charged with felony aggravated animal cruelty for an incident in November.

Authorities say Damian-Rosas tied a dog to the tracks and left him to get hit by a train, according to a news release from Hall County Animal Control.

“There was evidence that the dog had been purposefully tied to the tracks, which ultimately led to his death,” Mike Ledford, director of Hall County Animal Services, said in a news release. “This was an egregious act of cruelty against a defenseless animal, and our department works tirelessly to hold those responsible for such acts accountable.”

Damian-Rosas’ lawyer, Mike Weaver, told the Gainesville Times “those facts, as I understand them, are not accurate at all” and that “there’s a lot of misunderstanding of what happened.”

Damian-Rosas is out on bond.
