Two Georgians seeking class action status in a lawsuit against Georgia Natural Gas on charges it overcharged scores of customers, may proceed with their case, the Georgia Supreme Court ruled Monday. The case, originally filed in February of 2008, was dismissed by a lower court. The two lead plaintiffs, Charles H. Ellison and Susan B. Bresler, appealed and successfully had the dismissal overturned. Georgia Natural Gas appealed to Georgia Supreme Court, leading to Monday's decision upholding the appellate court's ruling. Lawyers for Ellison and Bresler say more than 300,000 former and current customers could be included in the suit against Georgia Natural Gas if the case is granted class action status.
