A 50-year-old DeKalb County man has been sentenced to three years in prison after pleading guilty to raping a 13-year-old girl, court records show.

Dale Antonio Davis was arrested in December 2017 after he approached the girl, placed a bag over her head, drove her to a house and raped her, initial arrest warrants claimed.

The attack happened off Waldrop Road between 10 p.m. on Halloween and the next morning at 4:30 a.m., The Atlanta Journal-Constitution reported in 2017.

Davis was initially charged with statutory rape, kidnapping, simple battery and child molestation. But only the rape charge was presented to a grand jury for Davis’ indictment, according to DeKalb court records.

He pleaded guilty and was sentenced earlier this month. In addition to the three years in prison, Davis was sentenced to serve seven years of probation.  He also must register as a sex offender and have no contact with the victim.

When Davis was arrested, he was out on bond for a misdemeanor charge in a family violence case, the AJC reported.

According to the initial warrants, the girl said she tried to fight off Davis, but he wouldn’t stop.

She later asked two men for help and they flagged down an officer.
