Sandy Springs has filed a lawsuit against Fulton County in Superior Court over two failing ponds at the Arlington Memorial Park cemetery.

The city hopes the court will force the county make about $500,000 in fixes to the ponds, where collapsed berms mean flooding for downstream residents every time the area has a heavy rain.

The flooding has been a hot issue in Sandy Springs, where residents have tried unsuccessfully to convince the city to make the repairs.

City officials say 30-year-old covenants require the county handle maintenance. The county, however, said it is prohibited by the state constitution to provide stormwater service within city limits
