The parents of a 10-year-old boy who died after he was pulled from the Westin Peachtree Plaza pool during a birthday party have sued the hotel and others over the incident.

The parents of Steven Akinlabi said the hotel owners and managers, plus two party chaperones, were negligent, according to the suit that was filed in Clayton County State Court on June 27.

The child was rushed to Children’s Healthcare of Atlanta at Scottish Rite on April 23 after he nearly drowned, The Atlanta Journal-Constitution previously reported. He died the following Wednesday.

The lawsuit names Starwood Hotels and Resorts Worldwide, Westin Hotel Management, SLC Atlanta LLC, and party chaperones Rico Ramalho and Monique Moshen-Ramalho, both of whom live in Clayton County, as defendants.

The hotel did not properly maintain the pool’s water and lighting and did not render sufficient emergency aid, according to the lawsuit. Also, the hotel did not properly hire and train employees, according to the lawsuit.

The plaintiffs, Abedeen and Camecia Akinlabi, are seeking a jury trial and damages for medical expenses and funeral costs as well as punitive damages.
