The parents of a 5-year-old girl who died after treatment for a broken arm at a Henry County clinic last year have reached a confidential settlement with the urgent care facility, Channel 2 Action News reported Monday.
Kensley Kirby fell and broke her arm last June. Her parents, Kenny and Delaney Kirby, took her to the Family Medical Clinic on Ga. 20 in McDonough.
Kensley died after physician's assistant Allan Imes injected her with three times the recommended dose of Lidocaine, a local anesthetic, state investigators determined.
Imes was suspended by the state medical board but reinstated last fall under a list of conditions, Channel 2 said.
Under the terms of the settlement, neither the clinic nor Imes accepted liability for the girl's death. A statement from the clinic to Channel 2 said: "We pray for the Kirby family daily and can't express enough how sad we are for their loss."
The family is still mourning.
"Obviously, the settlement doesn't matter," Kenny Kirby told Channel 2. "We'd love to have our daughter back."
Delaney Kirby said, "We talk about [Kensley] every day, don't we? Talk to her, about her. She's definitely part of our lives, still, and always will be."
