A federal judge has dismissed a $500 billion dollar lawsuit filed by a Gwinnett County woman accused of child cruelty.
Therian Wimbush filed the lawsuit from jail against the Governor, state, attorneys, judges and others.
She claimed her constitutional rights were repeatedly violated. The federal judge tossed out the lawsuit Wednesday, but said Wimbush could refile with some corrections.
The lawsuit follows a $500 million civil suit.
Only Channel 2 Action News was in court Tuesday when a defendant told a judge that she was going to sue her -- and the judge fired back.
Wimbush is suing almost everyone involved in her case for slander --- asking for a half million dollars in damages.
That made for a tense hearing Tuesday afternoon when she appeared before one of the judges whom she's suing.
"Why is it you have all these complaints about me yet you want me to stay on the case?" asked Judge Karen E. Beyers.
Over the course of her criminal case for child cruelty, Wimbush has filed a slew of motions, but none of them would be decided Tuesday.
Despite the fact she's suing Superior Court Judge Karen Beyers as part of her $500 million civil suit, she still wanted the judge to handle the case.
- Beyers: "Have you in fact filed a lawsuit against me?"
- Wimbush: "Have I filed a lawsuit against you?"
- Beyers: "Yes ma'am."
- Wimbush: "Is this an appropriate question?"
- Beyers: "Have you filed a lawsuit against me?"
When Wimbush finally answered yes, the judge recused herself from the case.
At issue is whether Wimbush and her husband, former Georgia Tech football player Recardo Wimbush, held their oldest son hostage, locking him in a basement room for months on end.

The Wimbushes say the boy was free to move around the house and was being disciplined according to their faith. The state has taken custody of the couple's 10 children.
Another judge will have to be brought to hear the motions. It is unclear when the case will go to trial.
This lawsuit is on top of another high-dollar lawsuit – the Wimbushes filed a $500 billion lawsuit against dozens of people, including Gov. Nathan Deal, the Gwinnett County government, Gwinnett County Police Department and the Department of Family and Children Services.
The family claims they were deprived of several Constitutional rights.
