Greg Murrey stood up in the upper deck of Turner Field last August to help Braves fans boo the Yankees' Alex Rodriguez, who had come out to pinch-hit.

But Murrey lost his footing, fell from his second row seat and then plunged 40 feet to his death.

In a lawsuit filed Tuesday, his family accused the Atlanta Braves and Major League Baseball of disregarding fans' safety by putting up inadequate guard railings. Murrey, 60, fell over a 30-inch railing. His family's suit asserts that such railings should be at least a foot higher, and it says that the Braves and Major League Baseball knew it and declined to incur the expense of raising the railings.

The Braves declined to comment. It is unclear whether railings at the Braves' new SunTrust Park in Cobb County will be any higher than those at Turner Field.
