On Monday, the couple’s 5-year-old son nearly drowned after getting stuck in a pool drain. A contractor working at the home revived the boy, who was alert while being transported to Children’s Healthcare of Atlanta at Scottish Rite.

Tameka Raymond claims other grievances in her court filings. She states she was not consulted before Usher V was enrolled in a school an hour from their father’s home, claiming the travel time is too far.

With their 5-year-old son still hospitalized, both entertainer Usher and Tameka Foster were in Fulton County Superior Court for a hearing to determine if Usher will keep custody of the couple’s children.

Fulton County Superior Court Judge John Goger is set to hear the child custody case to determine if Usher will keep custody of his two boys.

Tameka Raymond also states she was not consulted in regards to the hiring and firings of the children’s caregivers, according to the report.

Tameka Raymond is looking for temporary primary custody of the children and temporary final decision-making authority with regards to the children’s education, health care, religion and extracurricular activities.

Tameka Raymond, dressed in black pants and an ivory blouse and jacket, exited the courtroom with her attorneys shortly after 2 p.m. The group returned about 10 minutes later.

Neither Usher nor his ex-wife looked at each other, both instead were looking down at phones, seemingly oblivious to the crowded courtroom awaiting the hearing, which began around 2:30 p.m.

In a statement Wednesday night, Usher said he’s “blessed and fortunate” that his son is recovering, the Associated Press reported.

Usher’s ex-wife Tameka Raymond filed documents Tuesday in the Fulton County Superior Court and was granted an emergency hearing for Friday regarding custody of Usher Raymond V and Naviyd Raymond, according to documents obtained by The Atlanta Journal-Constitution.

“(Usher) leaves the minor children in the care of a third-party approximately 85% of his parenting time due to his work related schedule, yet refuses to allow the children to remain in my physical custody while he is out of town,” Tameka Raymond stated in the motion.

Usher, dressed in a light tan suit, spoke briefly to his attorneys. On his right hand, he was wearing what appeared to be a hospital identification bracelet.

Usher’s attorney contends the incident was an accident, and that those at the home helped save the child’s life. Usher was granted full custody of the two boys nearly a year ago.

5-year-old Usher Raymond V got stuck in a pool drain at Usher’s rented Atlanta home and was rescued by a contractor who administered CPR. The child was alert while being transported to the hospital.
