Marietta police have charged a man accused of firing a pellet gun towards another person and trying to rob him of $5 behind a restaurant.

Ligon McWhorter Durham is charged with one count each of aggravated assault with intent to rob and reckless conduct following the Aug. 24 altercation behind Johnnie MacCrackens Celtic Firehouse Pub on Atlanta Street.

According to an officer’s narrative spelled out in an arrest warrant, Durham, 72, placed himself behind the business with a Daisy Powerline model 415 pellet gun pistol. He discharged the pellet gun into the parking lot curb just as a man was walking towards the back of the restaurant.

Durham allegedly “demanded $5” from the man for parking his car in the parking lot. The man refused and went inside the restaurant. Police were called to the restaurant, and Durham told cops he “was there to ensure those who parked in the parking lot paid the $5 fee.” He also told the officer that he discharged the pellet gun to “test it out.”

The office reached out to the property owner of the parking lot, which said it did not have an attendant on duty and that Durham was not hired to collect parking fees for anyone using the lot.

Durham was booked into the Cobb County jail on a $25,000 bond. As of Wednesday morning, he has not been released on bail.
