A Cobb County judge on Saturday rejected a General Motors request to dismiss a lawsuit aimed at throwing out a settlement between the automotive giant and the family of a Georgia woman who died in one of the brand’s cars.
The family of Brooke Melton, who was killed in 2010 after losing control of a 2005 Chevy Cobalt when the car’s ignition switch failed, is seeking to take the company back to court after recent allegations revealed that GM was aware of the defect but hid the evidence.
Melton’s parents, Ken and Beth Melton, settled for an undisclosed amount last September, months before disclosures by GM to the National Highway Traffic Safety Administration and Congress that contradicted earlier statements about the ignition switch issues. The couple is claiming fraud, negligence and concealment in a new lawsuit against the automaker.
