The lawyer for a man accused in a quadruple murder in Henry County said his client was a victim of circumstance.

Mathew Baker, 19, didn’t have his hand on the gun — or any gun — in the shooting at a house party, according to his lawyer. Baker was one of five men charged in the deadly Oct. 27 shooting. He and Jacob Kosky, 22, were charged with four counts of murder.

Baker’s lawyer, Jordan Van Matre, said his client was involved in something “far beyond his control.”

“We do feel like fear played a large factor in everybody’s actions that night,” Matre told Channel 2 Action News after a preliminary hearing Wednesday.

According to police, Baker followed Kosky to the party on Moccasin Gap Road in McDonough, where the two allegedly shot and killed four people.

No motive was given, but authorities testified that Kosky was upset with many of the party-goers and that Baker and Kosky met at a shed near the house before the gunfire.

“I asked Mr. Kosky, did you tell Mr. Baker what your plans were, what he was coming down there to do. (Kosky) said, 'I don’t know if he thought I was kidding, but I told him everybody in the house was going to get it,’” Henry County police detective David Lecroy testified.

Baker and Kosky remain in the Henry County jail as they await their grand jury hearings.
