A man was arrested Friday in Cleveland after allegedly hitting and killing a pedestrian with a motorcycle in Forsyth County over the weekend and driving away.

David Emory Castleberry, 36, of Cumming, is accused of the hit-and-run that killed 27-year-old Jose D. Ramirez Labra on Sunday, the Forsyth County Sheriff’s Office said in a news release.

The incident happened shortly before 4 a.m. Sunday along Dahlonega Highway, AJC.com previously reported. A damaged black and green Kawasaki ZX-1000 was found nearby along the side of the road, the sheriff’s office said.

Deputies were eventually able to track down the original owner of the Kawasaki, who identified the driver as Castleberry, the release said. Deputies then obtained warrants for second-degree homicide by vehicle, hit-and-run, habitual violator, removing or affixing a license plate and not having insurance.

Castleberry served two stints in prison since 2004, which both lasted about five years, according to Georgia Department of Corrections records. He’s been convicted in Forysth County of charges including DUI, theft and fleeing police.
