No charges will be brought against a Georgia State Patrol trooper who fatally shot a man after he led authorities on a chase in June, the Gainesville Times reported.

The incident involving GSP Sgt. Auston Allen began about 8:30 p.m. June 25 at a DUI checkpoint on I-985 in Hall County, The Atlanta Journal-Constitution reported.

A Ford Explorer driven by Rodrigo Guardiola, 36, took off and attempted an illegal U-turn, GSP Capt. Mark Perry said at the time.

Allen followed Guardiola, the GSP said. The chase ended on Industrial Boulevard in Gainesville when the SUV crashed into a patrol car. Guardiola and another man who was inside the SUV ran from the scene.

About a mile away, Allen fatally shot Guardiola, who resisted being handcuffed and tried to hold Allen under water, Perry said.

Northeastern Judicial Circuit District Attorney Lee Darragh decided not to bring charges, the Times reported.
