The Georgia Bureau of Investigation said it is looking into the shooting of an armed man by an off-duty Atlanta police officer early Saturday.

The man, who was identified as Pedro Maldonado, 41, was taken to Grady Memorial Hospital, GBI spokeswoman Nelly Miles said. He was in critical but stable condition. The officer was not injured. He was not identified by the GBI.

Between 12:40 and 1 a.m., Maldonado and a man identified as Raul Delacruz, 48, were standing in front of Maldonado’s apartment in the 1000 block of Collier Road when they were approached by an armed man who robbed Delacruz of cash, Miles said.

Several witnesses reported hearing gunshots, Miles said.

At this time, the Atlanta officer, who had just completed his shift, was in the area and also heard the shots, Miles said. The officer reportedly observed Maldonado running with a gun in his hand. When the officer encountered Maldonado, he fired multiple times, striking Maldonado.

Evidence from the scene is consistent with Maldonado being armed and shot by the officer, Miles said. There is also shell-casing evidence of shots being fired from a gun that has not been recovered.

Atlanta police asked the GBI to investigate, which is standard protocol in officer-involved shootings.

The GBI will turn over the investigation results to the Fulton County District Attorney’s Office for review, Miles said.
