Following a public hearing, the Peachtree Corners City Council approved a Metropolitan River Protection Act Certificate to authorize construction of a new single-family home and landscaping on 1.46 acres at 4348 Riverview Drive in the Riverview Estates subdivision.

In 1973, in response to growing concerns about the Chattahoochee River, the Georgia General Assembly enacted the Metropolitan River Protection Act (MRPA). It established a 2000-foot corridor along both banks of the Chattahoochee for the 48 miles between Buford Dam and Peachtree Creek.

The Act requires the Atlanta Regional Commission to protect the Chattahoochee River Corridor and to review new development proposals. Local governments must implement the ARC plan by issuing permits, monitoring land-disturbing activity in the corridor and enforcing the act and the plan.

The existing residence was built prior to the MRPA and has been demolished by the owner to build a new residence. The development must obtain a Chattahoochee River Corridor Certificate, since this property currently does not have one.

The City Council’s approval came with conditions including requiring the owner to file the certificate with Gwinnett County and to provide as-built survey and info confirming the built conditions prior to issuance of certificate of occupancy. There will not be an increase in land use density as a result of this approval.
