Another victim of an April shooting aboard a MARTA train has filed a lawsuit against the transit agency.

Ernest Butler was shot April 13 on a train at the West Lake Station in an incident that left one man dead and three people injured.

A Clayton County man, Chauncey Lee Daniels, has been charged with murder and aggravated assault in connection with the incident. According to police, Daniels fatally shot Zachariah Hunnicutt, 38, and injured the other victims.

In a lawsuit filed July 26 in Fulton County Superior Court, Butler says MARTA failed to warn its customers about criminal activity at its facilities and provided inadequate security.

It's at least the third lawsuit resulting from the incident. In May, Hunnicutt's wife and another shooting victim filed separate lawsuits against MARTA, making similar arguments.

MARTA did not immediate respond to a request for comment and has not commented on the previous lawsuits.
