Fayetteville investigating developer penalty
Fayetteville’s city staff is looking into whether an outstanding penalty will affect plans to build a Dollar General store off E. Lanier Avenue. The property, which was discussed at a town hall meeting on Aug. 30, is part of a 15-acre tract off Weatherly Drive that was clear-cut without a required permit in 2014.
The owner, 54 Development, was ordered to replant trees and, according to a city ordinance, should have been banned from developing the property for three years.
Nearby residents raised the moratorium issue when plans for the Dollar General were announced, but two city council members and City Manager Ray Gibson were not in their posts at the time of the violation and did not know its status. Gibson said he will discuss the matter with the city attorney to determine if building permits for the site will be affected.
