A reluctant Fayette County Board of Commissioners voted 3-2 recently to deny a disabled veteran’s request for a retroactive tax exemption, but will pursue the larger policy issue.

In May, Peter L. Davis applied for a Disabled Veterans’ Homestead Exemption and asked to be reimbursed $7,658 for property taxes dating back to 2010. However, County Attorney Dennis Davenport said that unlike federal benefits, county exemptions are not retroactive.

The commissioners expressed sympathy for Davis, but the majority decided that granting the reimbursement would set a problematic precedent. The commissioners directed County Manager Steve Rapson to pursue the issue with the Association County Commissioners of Georgia for possible changes in the state law.
