DeKalb County police have charged and arrested a man accused of causing the death of his passenger in an August wreck on U.S. 78.
Dwayne Weaver, 52, of Jasper, is charged with driving on a suspended license, reckless driving and vehicular homicide in the death of Forrest Kelly, 61, of Lilburn, warrants show.
Initially after the Aug. 12 wreck near Hugh Howell Road, police said a “hit-and-run” driver was at fault in the wreck. They asked for the public’s help finding the driver, who had been in a Chevrolet Camaro and struck Weaver’s Nissan Titan truck.

But records show the Camaro driver has been identified and hasn’t been charged.
Police now say Weaver was at fault because he attempted to use the emergency lane to pass the Camaro, causing an apparently minor collision. The wreck sent the truck out of control and into a concrete median, but didn’t appear to disrupt the path of the Camaro, dashcam video from another driver shows.
Details on the cause of Weaver’s license suspension weren’t immediately available. Jail records show he was charged in DeKalb with driving on a suspended license twice in 2015, as well as once in 1989.
Weaver, who was arrested Saturday, remained in the DeKalb jail on $1,500 bond Tuesday.
