No charges will be filed in the death of an 11-year-old boy struck as he headed to his school bus, the Georgia State Patrol said Tuesday.

Thomas Conor Burch, of Locust Grove, died April 12 after stepping into the roadway at Tanger Boulevard and Locust Grove Griffin Road, investigators said. Conor was struck by a vehicle traveling in the opposite direction from the approaching bus and was airlifted to Children's Healthcare of Atlanta, where he died.

Investigators reviewed video footage from the school bus and interviewed witnesses before deciding no charges would be filed, Gordy Wright, GSP spokesman, told The Atlanta Journal-Constitution.

“The bus had not come to a stop yet and had not activated the red lights and stop arm when the child entered the path of the van,” Wright said in an emailed statement Tuesday night.

Investigators believe Conor crossed into the path of a southbound Ford Windstar being driven by Claudia Inez McGahee, 57, and was hit around 7:40 a.m. McGahee, of Locust Grove, stopped and called 911, Henry County police previously said.

Conor, a 6th grader at Locust Grove Middle School, wore No. 23 for his little league baseball team.
