Two members of an anti-annexation group called No2Decatur have filed a lawsuit against the city over an annexation nearly two years ago along Midway Road.

The suit claims that one of the signatures on the original annexation petition is not that of the actual homeowner and therefore invalid. It also claims that one of the plaintiffs, Eunice Elise Young, was unaware her property had been annexed. Among others, the suit seeks to “set aside the annexation” and also refund city taxes Young’s paid since annexation.

The suit has been delivered to the city attorney, said City Manager Peggy Merriss adding that this is Decatur’s first ever annexation-related lawsuit.

Decatur approved annexing five properties on Midway in March 2013, through the 100 percent petition method. Since 2011 the city’s annexed 148 properties through residential petition, entirely separate from the current large-scale legislative annexation the city’s attempting.
