A mistrial was declared Tuesday on rape and kidnap charges over a 2013 incident that started in the parking lot of a Gwinnett County Wal-Mart.

However, Emmanuel Brandon Dupree was convicted of simple assault and theft, Channel 2 Action News reported. The Gwinnett County Superior Court jury had been deliberating since Friday.

Dupree was sentenced to six years in prison. He will receive credit for time served, which means four years remain on his jail term.

The charges arose from an Oct. 20, 2013, incident involving Dupree and a woman outside the Wal-Mart on Lawrenceville-Suwanee Road.

The woman testified she was dragged into a car at knifepoint, driven away and assaulted, Channel 2 reported.

Dupree testified he had consensual sex with the woman, Channel 2 reported. He said what witnesses described as an attack was him trying to give a friend a hug.

The jury saw a security video from the meeting during the trial. Also, jurors twice asked to review the video after they began deliberations.
