An October hearing has been set for one of the Memphis men charged with kidnapping, armed robbery and other crimes in a Buckhead home invasion.

U.S. Magistrate Gerrilyn Brill set Oct. 8 to handle evidence matters in case of Leon Scott after a brief hearing Thursday on the case.

Scott and Mario Deandre Jackson, both of Memphis, have been indicted in the May 8 home invasion on Paces Ridge Road.

Jackson’s case is being handled separately at this time and may have a separate evidentiary hearing, said Bill Morrison, a lawyer for Scott.

The $3 million Buckhead home that was allegedly robbed was occupied by a husband, wife and three minor children. The suspects drove the husband to an ATM to force him to withdraw cash, prosecutors said. The robbers demanded more money by morning and threatened to harm the family if demands were not met, police said at the time.

Atlanta police detectives learned through a Crime Stoppers tip that the suspects in the robbery were from Memphis., where detectives recovered a wedding band stolen from the Buckhead home at a pawn shop, which authorities said Scott had pawned.

Georgia State Patrol officers on July 9 stopped a car in which Jackson was a passenger and found him with two firearms, both of which had been stolen during other robberies in Atlanta and Memphis, prosecutors said. Scott was arrested separately in a motel in Birmingham July 24.

Both Scott and Jackson have pleaded not guilty.
