Norcross-based ServiceKey, a provider of IT hardware maintenance and professional services, said it has settled a lawsuit filed last year by Oracle, accusing the company of conspiring to sell its copyrighted software.
Oracle accused ServiceKey and another company, Delaware-based DLT Federal Business Systems Corp., of being involved in a “grey market conspiracy.” The suit, according to previously published reports, claimed the companies stole software patches and updates for proprietary software that they later sold to federal agencies and other customers.
ServiceKey said Friday the settlement resolves Oracle’s claims and that it will not have to pay any damages to the California-based computer hardware and software company.
“From the beginning of this litigation, ServiceKey has complied with our obligations to the legal system and to ensure we are following the law,” Chief Executive Officer Angela Vines said in a statement. “The proposed settlement represents significant progress toward an understanding between Oracle and ServiceKey, with respect to ServiceKey’s appropriate role in the hardware service support market for Sun/Oracle systems.”
Vines has maintained in previous reports that her company has never had any “direct or indirect business relationship” with DLT Federal Business Systems.
Oracle filed the suit in U.S. District Court in California in February 2012. The settlement still has to be approved by a federal judge.
