Microsoft Corp., the multibillion-dollar company behind the Windows operating system and other software products, is suing a Gwinnett County company, claiming infringement of its copyrights and trademarks.

In the lawsuit filed this week in U.S. District Court in Atlanta, the company claims Capital Remarketing Services Inc. in Duluth and its owner, Jean Paul Divirgilio, advertised, installed and distributed unauthorized copies of Microsoft software without its permission.

A person identifying himself as “John” on Wednesday said the company doesn’t “load software” and indicated Capital had been in contact with Microsoft. He said the company would have no further comment.

Microsoft is seeking unspecified damages. Capital joins other metro Atlanta companies that have been targeted by the software maker, including VertexPC, which is another Gwinnett company, and Ebix, an Atlanta-based provider of software to insurers.

Capital sells a range of computer hardware and software online, including replacement parts and units. The company’s website says it has been in business for more than 16 years.

Microsoft’s suit says two of its investigators were sold products with unauthorized Windows software in April and October of last year, after Capital was warned about the alleged infringement in November 2013.
