It's hard to judge season 4 "Idol" man Constantine Maroulis after his arrest last week on a domestic violence dispute with his daughter's mother Angel Reed.
TMZ broke the splashy story. Who was at fault? It's hard to say since we weren't in the room when it happened. She said he attacked her. He claimed self defense.
He was released on bail after his arrest but was re-arrested Sunday when he broke a restraining order by emailing her.
"He accidentally emailed her which broke the restraining order and he was arrested and immediately released," a Maroulis rep told Billboard. "It was not a personal email -- it was a pure accident..
If anything, both have restraining orders against each other.
Reed's attorney Steve Mandel told People magazine in a statement : "The initial argument started when Reed confronted Mr. Maroulis with photos and emails she found proving he was continuing an affair with a married mother of a child at their daughter's school." He then hit her and she ran to the bathroom to call 911, Mandel wrote. Maroulis then fled and was arrested later.
Maroulis said he had approached her to tell her he had broken up with her but she became angry and began hitting him and throwing things at him. He said he was the victim.

Kelly Clarkson's single "Invincible" is one of her weaker offerings. It didn't make it top 40 and just peaked at No. 11 on the Hot AC chart.
Adam Lambert's "Ghost Town" slips to 18, after peaking at 16 on the Hot AC chart. It also moved up to 22 on the top 40 chart. Nick Fradiani's "Beautiful Life" also falls off from 27 to 28 but is still gaining airplay.
Colton Dixon's "Through All of It" is at no. 13 on the Christian AC chart. Peak so far after 20 weeks: 12.

Clay Aiken was seen at a D.C. stage performance but the Washington Post has no answer what he's been doing since his failed Congressional run and the reality docu-series on Esquire earlier this year. On Saturday, Aiken did fill in for Ryan Seacrest as host of the Philadelphia auditions with the judges. (Seacrest rarely misses auditions like this.) Harry Connick Jr. told press day one was not impressive but hope springs eternal.
