A residency challenge to Tyrone Brook Jr.'s candidacy for the state House seat vacated by his father has been filed with Secretary of State Brian Kemp.

The complaint notes that the younger Brooks was a registered voter outside House District 55, located in Atlanta, last November.

The special election is June 16. The final decision on the matter will be made by Kemp, though a spokesman said he wasn’t sure when that would happen. Scroll through the complaint below:

The elder Tyrone Brooks, 69, a longtime civil rights leader, resigned his seat in April, hours before pleading guilty to one count of federal tax fraud and no contest to five more charges of mail and wire fraud.

He has not yet been sentenced.
