Judge denies Usher’s bid to dismiss herpes case

A woman’s herpes lawsuit against Usher will go forward after an Atlanta judge denied his bid to dismiss it.

Judge Kelly Lee Ellerbe threw out the star’s motion to dismiss Lauren Helm’s case, her attorney Scott Lawrence Keniley told the Atlanta Journal-Constitution.

While Usher, born Usher Raymond, said Helm should have known the risks involved with unprotected sex and that she could not prove she contracted the virus from him, the judge ruled that Helm successfully argued that the artist did cause her illness, Keniley confirmed.

Furthermore, the lawyer said Raymond did not deny having the virus. In fact, Raymond’s motion might have been used as a “delay tactic,” Keniley said.

Ellerbe's decision will now allow Helm's case to move forward. Next, Keniley said he will request Raymond's medical records. In August, a California judge ordered the crooner to hand over his medical records after a man identified as John Doe also accused him of giving him herpes.

A woman identified as Jane Doe and Quantasia Sharpton took civil action in 2017 against Raymond with the same claims.

Helm filed her case against Raymond in April, listing multiple counts of negligence, fraud, and intentional and negligent infliction of emotional distress after she said she had sex with him on two occasions in 2017.

Raymond has denied "each and every allegation" made against him.
