Apollo Nida, who has spent more than two years in prison for financial fraud, filed divorce papers in Georgia on Thursday against Phaedra Parks, according to TMZ.

Oddly, Parks told TMZ recently she had filed papers against him but that court filing has never surfaced.

UPDATED: I procured a copy of the filing myself from Fulton County Superior Court.

Nida has been in prison since 2014 for bank and identity theft to the tune of about $2 million. His prison sentence: eight years. He has asked for joint legal custody of their two sons, Ayden (six) and Dylan (three.)

The couple married November 1, 2009 after Nida left prison for a prior five-year sentence for racketeering. The filing says they have been in a "bonafide state of separation" since June 2014. He entered prison three months later. He describes the marriage as "irretrievably broken" and "there is no hope of reconciliation." He seeks an "equitable division of all personal properties and assets accordingly."

On "The Real Housewives of Atlanta," which was taped months ago, Parks said she was close to getting divorced and was ready to start dating, though we have not seen any evidence of that.

Nida, on the other hand, met someone while in a New Jersey federal pen. Sherien Almufti, a New Jersey real estate agent originally from Jordan, is reportedly engaged to him. How they met is not clear.
