The Sandy Springs City Council has created a process for taking bond or bail money collected by the municipal court and left unclaimed.

City Attorney Dan W. Lee recommended the action after learning city ordinances did not provide for the disposition of unclaimed bonds. The money would have been posted by alleged offenders to ensure their appearance in court.

The city can lay claim to a bond one year after a defendant was required to appear in court, or one year after the disposition of a case by the prosecutor or the court, including any appeal, verdict or sentence, according to the ordinance approved by the council.

Notice will be given by mail to the last address given by the person or entity that posted the bond. If no address is known or found, notice will be given by publication in a legal organ and by posting to the city’s website at least 30 days prior to the transfer of funds to the city’s general fund.
